2. Purpose and scope of application

The present Terms and Conditions of Use regulate the access, navigation and use of ENTEX TEXTIL’s Web Site (hereinafter, “the Web Site”), as well as the responsibilities derived from the use of its contents (understanding by “contents” the texts, graphics, drawings, designs, codes, software, photographs, music, videos, sounds, databases, images, expressions and information, as well as any other creation protected by national laws and international treaties on intellectual and industrial property). Likewise, “User” means the person who accesses, navigates or uses the services and activities, free or onerous, developed on the Website.

It is understood that the access or the mere use of the Website by the User implies his or her adherence to the Terms and Conditions published from time to time. Consequently, the User is invited to carefully read these Terms and Conditions from time to time.

These Terms and Conditions of Use are not intended to regulate any contractual aspects relating to the provision by ENTEX TEXTIL of its specific services, and are limited to being the legal framework for use and access to the Web Site.

3. Access and use of the Web Site

Access to the Web Site by Users is free of charge.

All information provided by the User through the Website, for example, in the “Contact” section containing personal data, shall be subject to our Privacy Policy. With regard to the information provided by the User, the User shall be responsible for the accuracy, completeness and truthfulness of such information.

The access, navigation and use of the Web Site is the responsibility of the User, who agrees to diligently observe any additional instructions given by ENTEX TEXTIL regarding the use of the Web Site and its contents, and not to use ENTEX TEXTIL’s service or its contents in any way that is not expressly authorized by these Conditions.

In particular, the User shall refrain from:

ENTEX TEXTIL reserves the right to remove any comments and contributions that violate the respect for the dignity of the person, which are discriminatory, xenophobic, racist, pornographic, that violate the youth or childhood, order or public safety or that, in his opinion, are not suitable for publication. In any case, ENTEX TEXTIL will not be responsible for the opinions expressed by users through forums, chats, or other participation tools.

4. Rights owned by ENTEX TEXTIL

ENTEX TEXTIL is the owner of all the intellectual and industrial property rights over the Website, including the domain name and all the contents available through it. In no case shall it be understood that the mere access or navigation of the User through the Web Site implies any kind of transmission, license or total or partial transfer of such rights by ENTEX TEXTIL in favor of the User, nor that the User is authorized to use or exploit such rights publicly.

5. Liabilities and Warranties

ENTEX TEXTIL manages the Web Site diligently and, therefore, tries at all times to maintain complete and accurate information on all services offered, updating it at all times. However, it is possible that, occasionally, there may be some discrepancy between the information offered on the Website and the reality of the service actually provided. For this reason, the User is invited to visit the Website regularly.

ENTEX TEXTIL has adopted at all times the appropriate measures, according to the state of the art known at all times, to ensure the proper functioning of the Web Site and prevent the existence of viruses or computer programs that may cause damage to Users.

However, computer security is not infallible and is exposed to certain risks as a result of the inevitable activity carried out by hackers and virus or malware programmers. Therefore, although ENTEX TEXTIL makes every effort to avoid this type of programs, and updates its computer and system security at all times, ENTEX TEXTIL cannot guarantee, nor is it responsible for any damages suffered by the User as a result of:

Website service failures or interruptions;
Viruses or computer programs or any elements designed for cybernetic attack or infiltration in the User’s computer systems that, inadvertently, may have been installed in these, thanks to or as a consequence of the User’s access to the Website;
The possible vulnerability of the Web Site and of the security measures adopted therein;

6. Links to Other Web Sites

On the Website, the User may find links to other Applications or Websites managed by third parties, such as, for example: Twitter, Facebook, YouTube or Instagram. ENTEX TEXTIL does not have the power to control all the information or content provided by third parties, so it cannot assume any responsibility for the quality and reliability of the same, or for the accuracy or adequacy of the content offered.

The establishment of any type of link by the Web Site to another web site or external Application does not imply that there is any type of relationship, collaboration or dependence between ENTEX TEXTIL and the responsible of such Web Site.

7. Duration and Modification

ENTEX TEXTIL may modify these Terms and Conditions, in whole or in part, by posting any changes in the same form in which these general conditions appear. Also, ENTEX TEXTIL will make every effort to ensure the continuity of service and operation of the Website. However, and to the extent permitted by law, ENTEX TEXTIL may terminate, suspend or interrupt, at any time and without prior notice, access to the contents of the Web Site, without the possibility for the User to claim any compensation, either for technical or maintenance difficulties.

8. Declaration of Nullity

The eventual declaration of nullity of any of the provisions of these Terms and Conditions shall not affect other provisions not affected by such declaration.

9. Applicable law. Competent Jurisdiction

These Terms and Conditions are governed by Spanish Law, without prejudice to the Website of any other regulation dictated by competent authority.

Any discrepancy between the User and ENTEX TEXTIL about the validity and validity of any provision contained in these Terms and Conditions shall be resolved judicially, in accordance with the rules of jurisdiction established in the applicable regulations.
